Sažetak
Zaštita ekonomskih interesa potrošača jeste važan segment zaštite ljudskih prava uopšte. S druge strane, ona se odražava na efikasnost delovanja tržišta, kao i na efikasnost privređivanja. Deluje u pravcu razvoja lojalne konkurencije između učesnika na tržištu i povećanja konkurentske sposobnosti privrede. Sve to omogućava zemlji integraciju i uključivanje u međunarodne ekonomske i političke tokove. U radu se razmatra samo jedan segment zaštite potrošača - zaštita njihovih ekonomskih interesa. A u vezi s tim, naročito prava odnosno obaveze koje, po mišljenju autora, zaslužuju posebnu pažnju. U prvom delu rada govori se o našim propisima. Prikaz ima pretenziju da pruži uvid o sledećem. Prvo, o ekonomskim interesima potrošača i o utvrđenim pravima i obavezama koje izražavaju te interese. Drugo, o sistemu i efikasnosti ostvarivanja tih prava. I treće, o nedostacima važećih propisa. U drugom delu ukazuje se na oblasti daljeg razvoja i izgradnje propisa o zaštiti ekonomskih interesa potrošača. Posebno, o harmonizaciji sa pravom Evropske unije. Odnosno, u vezi s tim, o onim oblastima koje imaju najširi značaj.
Abstract
The protection of consumers’ economic interests is an important segment of human rights protection. On the other hand, it is reflected both on the market efficiency and on the economic efficiency. It is aimed at developing loyal competition between the participants on the market and increasing the competitive capacity of economy. It helps the country’s integration and association into the international economic and political currents. In this paper, the authors consider only one segment of consumer protection - the protection of their economic interests, with particular reference to their rights and duties which - in the authors’ opinion - deserve special attention. In the first part of the paper, the authors deal with our legal regulations. The aim of the survey is to offer an insight into the following issues: 1) the consumers’ economic interests and the prescribed rights and duties expressing those interests; 2) the system and efficiency of exercising these rights; and 3) the shortcomings of the existing legal regulations. In the second part of the paper, the authors point to the areas of further development and upgrading of legal regulations pertaining to the protection of consumers’ economic interests, particularly regarding the harmonization with the EU regulation in this field and in the respective areas of general importance.
