Beginning of right to life protection on American continent

Abstract

The general attitude of the international law regarding the abortion may be characterized as pro life at least at the time when the regional instruments for protection of human rights were adopted. At the American continent these instruments are pro life thanks to the countries of the Latin America. The international law in general should be rather grateful to this group of countries for the development of the protection of the right to life through the instruments of human rights protection. National legislations at the American continent are classified into two groups - pro life (the south of the continent) and pro choice (the north of the continent). There is a new group of legislation emerging in the USA - pro information. The essence of the new group is comprised in the logic that without complete information one cannot have complete freedom of choice. It is a legal solution which requires presenting biological facts to potential mothers by using ultrasound. Biological facts are relevant for the beginning of protection of life by the right to life at the American continent. For regional documents this is conception. For national legislations these include either conception or viability. Using biological facts in order to determine subject of the right to life is characteristic of this region.
