Sažetak

Naknada troškova koje je podnosilac imao vodeći postupke predstavlja poseban oblik pravičnog zadovoljenja koji nije izričito predvđen u čl. 41 Evropske konvencije o ljudskim pravima. Nadoknađuju se kako troškovi koje je podnosilac predstavke imao pred domaćim organima, tako i oni u postupku pred samim Evropskim sudom za ljudska prava. Besplatna pravna pomoć za pokrivanje troškova daje se ukoliko je to neophodno za pravilno vođenje postupka i ako podnosilac predstavke nema dovoljno sredstava da ih plati. Kroz sudsku praksu ustanovljena su četiri uslova koji se moraju kumulativno ispuniti da bi troškovi bili refundirani, i to: da su nastali u vezi sa povredom Konvencije; da su stvarno učinjeni; da su nužni; i da su razumni u pogledu visine. Sud dosuđuje naknadu troškova na zahtev aplikanta i to ukoliko je on potkrepljen validnim dokazima. O podnetom zahtevu Sud može odlučiti u glavnoj presudi o suštini spora ili ga odložiti i rešiti u posebnoj presudi.
