Sažetak
Decembra 2015. godine Evropska komisija pokrenula je reformu prava potrošača objavljivanjem dva predloga novih direktiva sa ciljem da se usklade pravila distancione prodaje. Trenutno prisutne razlike u pravu država članica otežavaju prekograničnu elektronsku trgovinu. Predmet ovog rada je 'Predlog direktive o određenim aspektima ugovora o prodaji robe na internetu i drugoj prodaji robe na daljinu'. U prvom delu su pobrojane najznačajnije razlike u odnosu na pozitivno pravo, nastalo pod uticajem Direktive o prodaji robe i pratećim garancijama. Najvažnije su promene povodom nivoa harmonizacije, rokova, tereta dokazivanja, kao i nova pravila o lakšem raskidanju ugovora. U drugom delu rada su detaljnije prikazani reformski predlozi o saobraznosti robe i potrošačkim pravnim lekovima. Mada nesumnjivo donosi veći nivo zaštite potrošača, predložena reforma udaljava distancionu od klasične prodaje između prisutnih lica i komplikuje ugovorno pravo potrošača uvodeći još jedan poseban režim prodaje.
Abstract
In December 2015 the European Commission launched a consumer rights reform by publishing two proposals for new directives in order to harmonize distance sales rules. At present, differences in national law of the Member States hamper cross-border e-commerce. The focus of this paper is 'Proposal for a directive on certain aspects concerning contracts for the online and other distance sales of goods'. In the first part, the author compared Proposal with positive law, formed under the influence of the Directive on certain aspects of the sale of consumer goods and associated guarantees. Changes are related to the level of harmonization, time limits, the burden of proof, as well as new rules on easier contract termination. The second part of this paper is about proposals regarding goods conformity and consumer's remedies. Although announced reform brings a higher level of consumer protection, at the same time it expands a gap between distance and traditional sales. Besides that, proposed reform complicates consumer protection law by adding a new set of rules to already divergent system.
