Sažetak
U okviru opštih razmatranja o klasičnim oblicima trgovačke kupoprodaje (kupovine na probu, kupovine sa rezervom kušanja, prodaje po uzorku, prodaje po specifikaciji, prodaje na kredit i prodaje uz pretplatu) autor naročito ukazuje na razliku između građanske i trgovačke kupoprodaje u pogledu vremena njihovog nastanka kao i u pogledu njihovog zakonskog regulisanja. Pri tome, ukazujući naročito na zakonske tekstove koji sadrže odredbe o pomenutim oblicima kupoprodaje, on polazi od predmeta i cene kao bitnih uslova za zaključenje ugovora i istovremeno kao od kriterijuma za razlikovanje osnovnih grupa oblika klasične trgovačke kupoprodaje.
Abstract
The general discussions regarding the classical forms of commercial sales contracts have been particularly directed to the problem of difference between the private law, form and the commercial form of the sales contract regarding the time of their origin, as well as regarding their legislative regulation. It has been particularly pointed out to the legal texts containing provisions on specific forms of the commercial sales contract. Each of these forms has not been treated with equal attention both in the comparative and the Yugoslav legislation. Three different, situations might be distinguished in this regard a very detailed regulation of relations arising out of the classical forms of commercial sales contracts (test purchase and hire purchase); recognition of the specific nature of only some of the foams of this contract within a single provision (sales according to a specimen and specification); identification of one form of sales contact with the other (a test purchase) or a complete lack of regulation of relations arising out of sales contracts. Starting from such a situation regarding the legislative regulation of the classical forms of sale, and, having in mind the contemporary needs the author concludes that there is a need today for changing of such a situation. Namely, those forms of sales contract gaining a wider and more frequent application, should be regulated in more detail, while the others should be given a corresponding place in contemporary legislation and be regulated in a measure contemporary commerce requires.
