Analyzing the right of the buyer according to the hire purchase agreement to pay the price in installments, as a right constituted in the interest of the buyer (for saving of his solvency), as well as in the interest of the seller (for a better disposal of goods at the market), the author points to a few basic questions and elements composing this right. Those questions concern the: limitation of the total amount of credit, terms for. the payment of the price interest as a constituent part of the installments and right of the buyer to pay the price before the expiry of the agreed term. To each of these questions the author devotes particular attention pointing to their specificities particularly to interest and interest rates in the regular and premature payment. In answering these questions he has consulted the solutions contained in the comparative and the Yugoslav law on this matter. According to the analysis of the mentioned questions the author concludes that the measures of protection of the interests of the buyer are related to the conclusion and the existence of the hire purchase agreement, while the measures for the protection of the seller are directed towards the performance of the agreement. By a balanced and maximal protection of the both contracting parties the structure of the agreement guarantees itself the realization of the wider social interest within the economic relations and their normal functioning.
