Consequences of opening the bankruptcy proceedings in Serbian procedural law

Abstract

This paper analyses provisions of the law, opinions of jurisprudence and positions of judicial practices regarding the most significant procedural consequences of opening bankruptcy proceedings which result in mandatory discontinuation of all court and administrative procedures and prohibition of execution and settlement. Various consequences on active and passive litigation have been pointed out. In particular, the paper discusses the issues related to the dismissal of untimely motions for a continuation of the discontinued court or arbitration proceedings. In the segment where this paper presents the rules on the concentration of trials before the bankruptcy court, the norms on attraction of jurisdictions are explained together with the exception of attraction of actual jurisdiction in labour disputes as well as the attraction of territorial jurisdiction and non-application of rules on retaining jurisdiction in passive lawsuits. Likewise, it analyses theoretical and practical matters related to the prohibition of execution and settlement, discontinuation and suspension of execution proceeding. The paper reaches a conclusion that the procedural law in force in the Republic of Serbia makes a distinction between active and passive litigation concerning requirements to be met for a continuation of a proceeding previously discontinued due to occurrence of procedural consequences of bankruptcy. The arbitration procedure may be continued provided that it is initiated prior to the opening of the bankruptcy procedure, but a new arbitration proceeding is not allowed to be initiated and the disputed receivables may be resolved by filing a civil lawsuit. Rules on the concentration of trials before the bankruptcy court do not apply to active litigation. The moratorium is a prohibition of implementation of individual enforced execution against the property of bankruptcy debtor for settlement of receivables of a single creditor. The paper presents a comprehensive scientific analysis of the most significant procedural consequences of opening bankruptcy proceedings under the new Serbian legislation.
