Abstract
The authors of this article analyze the obligation of insurance companies to provide the potential consumers of insurance services with pre-contractual information, based on the provisions of the Insurance Law and other regulations in the Republic of Serbia. At the same time, they are trying to draw attention to the need to set certain guiding principles regarding the fulfilment of obligation of providing pre-contractual information with the aim to achieve predefined objectives or purposes of providing the consumers of insurance services with pre-contractual information. Thus, the authors set three basic principles of providing pre-contractual information: 1) the individual approach to the obligation of providing pre-contractual information; 2) providing concise, clear and understandable information; 3) providing timely information. The central part of the article is devoted to the individual information that insurance companies are required to communicate to the potential policyholder prior to the conclusion of the insurance contract, with particular emphasis on the practice of insurance companies in our country in the period after the entry into force of the new Insurance Law. In addition to the content of each specific information that is communicated to the potential policyholder and the problems that can arise in practice in some cases, the authors deal with the issue of proving the fulfillment of this obligation by the insurance companies.
