Collecting from a debtor undergoing liquidation

Abstract
The article analyzes the legal protection of creditors of a debtor undergoing liquidation. From the moment of initiation of the liquidation proceedings, creditors can collect debts incurred before the proceedings were initiated only within the proceedings, based on timely reporting of their claims. Depending on the assessment of reported claims and the viewpoint of the liquidator, creditors can secure full protection through the liquidation proceedings or seek further protection in judicial proceedings. As the liquidation procedure is insufficiently regulated in Serbian law, consequently there are numerous contentious issues in practice relating to legal protection of creditors, which will be discussed in this paper. Among the most important are the issues of whether a claim which a creditor reported on time in the liquidation proceedings, and the company did not dispute on time, is considered recognized under the law, and whether a creditor whose claim is disputed in liquidation proceedings needs to initiate a lawsuit seeking declaratory or condemnatory judgment.
