Procedural aspects of the application of laws regulating intellectual property rights

Abstract
In the years of harmonization of laws regulating intellectual property rights, domestic practice has faced the special challenge to follow the new rules and actually advance the standard of their protection. The subject of this paper is analysis of compliance of these laws with procedural rules which enable effective exercise of rights and provide the reform with the practical purpose. The focus of our research shall be the norms which regulate the procedural institutes in a special manner, in particular: the requirements for court protection, deadlines, active legitimation, burden of proof, legal remedies and enforcement tools. Bearing in mind the initial presumption - the special solutions are in compliance with general procedural laws, we shall consider the relevance of the issues raised in practice, and also their impact on the effective legal protection of intellectual property rights.
