Transfer of property in the Anglo-Saxon law

The Anglo-Saxon law endorses the consensual principle, i.e. the rule according to which property is transferred by the consent of the wills of contracting parties. However, if such a transfer is to have effect towards third parties it is often necessary to fulfil some additional conditions such as: delivery of goods, singing of documents or notifying the other party. So, the transfer of property may have effect only between the contracting parties, while in other circumstances there exits the transfer of property with effect towards third parties. Also, there is the 'sale' with property law effect, and the 'agreement to sell' or future sale having exclusively the law on obligations character. Court`s practice and statutory provisions have established a series of rules regulating the modes of property transfer depending on whether it is the case of 'determinate' or 'indeterminate' goods.
