Abstract
In the paper, the author at the beginning defines euthanasia and some preliminary issues relevant to the delimitation of the concept of active and passive euthanasia and their significance. The first part will be devoted mainly to the development of the idea of euthanasia. The second part of the paper is criminal justice part. In this part the author gives special emphasis on Serbian legislation and Article 117 and 119 of the Criminal Code of the Republic of Serbia. The author is trying to determine the place of euthanasia in our criminal justice system and wonders whether is it justified that there are two criminal offenses that regulate this issue in the Serbian Criminal Code.
