Primjena regulative Brisel II bis na ostvarivanje prava na kontakt sa djetetom šireg porodičnog kruga lica

Sažetak
U ovom radu istražujemo izvore prava Evropske unije kojima je uređen jedan segment roditeljske odgovornosti - pravo na kontakt sa djetetom. Naše istraživanje se dotiče prelaska sa konvencijskog (međudržavnog) uređivanja oblasti pravosudne saradnje za bračne sporove i pitanje roditeljske odgovornosti na uređivanje koje su vršile institucije Evropske unije, pri čemu je posebna pažnja usmjerena na Regulativu Brisel II bis. Kratko ukazujemo na njen odnos sa Haškom konvencijom o građansko-pravnim aspektima međunarodne otmice djece, Haškom konvencijom o nadležnosti, mjerodavnom pravu, priznanju, izvršenju i saradnji na području roditeljske odgovornosti i mjera za zaštitu djece, te drugim međunarodnim izvorima prava, dok se detaljnije bavimo njenim odnosom sa Regulativom Brisel II bis recast, koja će se primjenjivati od 1. avgusta 2022. godine. Odnos sa potonjom analiziramo isključivo u području prava na kontakt sa djetetom. Pored navedenog, analiziramo prvi predmet u kojem je Sud pravde Evropske unije odlučivao u pogledu primjene Regulative Brisel II bis na zahtjev baka i djedova za ostvarivanje prava na kontakt s djetetom, u smislu da li se nadležni sud, koji treba da odluči o načinima ostvarivanja takvog prava, određuje na osnovu navedene regulative ili na osnovu pravila međunarodnog privatnog prava država članica. Predmetni rad je koristan za stručnu i naučnu zajednicu jer se, između ostalog, bavi pitanjem opravdanosti donošenja posebnog izvora prava koji bi na ravni Evropske unije uredio pitanje uzajamnog izvršenja sudskih odluka o pravima na kontakt sa djecom, kako je to predložila Republika Francuska, inicijalno rukovođena osnovnim pravom djeteta na kontakt sa oba roditelja.
