Sažetak
Principi bona fides je tradicionalno, od strane mnogih pravnih sistema označen kao osnova ugovornih odnosa. U međunarodnoj areni ugovornog prava ovaj principi je inkorporiran u relevantnim pravnim instrumentima, u Konvenciji Ujedinjenih Nacija o ugovorima o međunarodnoj prodaji robe (CISG) i Principe Evropskog ugovornog prava (PECL). Međutim, uloga principa bona fides ce veoma razlikuje u ovim pravnim instrumentima. Uz to, sadržina ovog principa nije jasno određena u ovim dokumentima. Cilj ovog rada je da ispita funkcije principa bona fides u CISG-u u PECL-u, ne bi li ce doprinijelo boljem razumjevanju principa bona fides na osnovu komunitarnih standarda zemalja članica Evropske Unije. U prvom dijelu ovog rada je analizirano prisustvo principa bona fides u dva međunarodna ugovora, CISG-a u PECL-a. U drugom dijelu su obrađeni komunitarni standardi principa bona fides u fer poslovanja u zemljama članicama Evropske Unije.
Abstract
The bona fides principle is traditionally, signified by many legal systems as the basis of contractual relations. In the international area of contract law this principle is incorporated in relevant legal instruments, in the United Nations Convention on Contracts for the International Sale of Goods (CISC) and the Principles of European Contract Law (PECL). However, the role of the bona fides principle differs to a great extent in these legal instruments. In addition, the content of this principle is not clearly determined in these documents. The aim of this paper is to examine the function of the bona fides principle in the CISC and the PECL, so as to contribute to the better understanding of this principle based on the community standards of the members of the European Union. In the first part of this paper, the presence of the bona fides principle is analyzed in two international agreements CISC and PECL. In the second part, the community standards of the bona fides principle are analyzed and fair business in the member states of the EU.
