O promenama Zakona o parničnom postupku

Sažetak
Predlog za promenu Zakona o parničnom postupku Radne grupe Društva sudija Srbije, poslužio je kao povod da se ukaže na defekte koji se sistematski ispoljavaju u zakonodavnom metodu, uključujući formulisanje rešenja u regulativama građanskog sudskog postupka u celini. Navedene manjkavosti nisu sagledane a takođe ni otklonjene prilikom formulisanja predloženih promena parnične procedure. Ukazuje se na sistematsko postojanje pravnih ali u gotovo istoj, ako ne i u naglašenijoj meri, vanpravnih upliva koji se moraju uzeti u obzir i maksimalno uvažiti ako se želi unapređenje ovog vida pravne zaštite. Ocena je da u predloženoj inicijativi takvog pristupa nema i da ga je neophodno garantovati i obezbediti.
Abstract
Amendments proposals for the Civil Procedure Act, offered by the Judicial Society of Serbia, was the incentive to analyze deficiencies, which have systematically been present in the legislative process, as well as to analyze the legal framework of the whole civil court system. These deficiencies, however, were not either detected or removed in the latest proposal for amending the Civil Procedure Act. Legal and non-legal factors were systematically ignored, despite the fact that they must be seriously taken into account if any advancement of legal protection is sought after. The conclusion is that this proposal does not include such approach and, which certainly should be changed in future.
