Globalizacija - 'zlatno doba' ili 'sumrak' prava intelektualne svojine?
Globalization: 'Golden age' or 'twilight' of intellectual property rights?
Sažetak
U ovom članku autorka se bavi uticajem procesa globalizacije svetske privrede na postojeći sistem zaštite prava intelektualne svojine. Nakon ukazivanja na osnovne posledice ovog fenomena na domen prava intelektualne svojine, autorka ukazuje na činjenicu da su ova prava poslednjih decenija doživela pravi procvat te da mnogi smatraju da je reč o njihovom 'zlatnom dobu'. Istovremeno, u članku je ukazano i na negativne posledice globalizacije i, analizom novih pojavnih oblika zloupotrebe ovih prava u domenu patenata i autorskog prava, učinjen je pokušaj da se ukaže na osnovne slabosti postojećeg sistema zaštite i predstave moguća rešenja koja nameće ubrzani razvoj novih tehnologija.
Abstract
The object of the present article is the analysis of the impact of the phenomenon of globalization on existing system of legal protection of intellectual property rights. The relationship between intellectual property protection and international trade has been one of the most controversial issues in global negotiations in recent years, but in spite of the efforts of international organizations in the field of harmonization and unification of intellectual property law those rights remain in the national competence. The author analyses newappearing forms of the violation of different intellectual property rights, particularly patents and copyrights, with the attempt to emphasize new possible solutions which can represent a starting point of a future reform of the system of legal protection of those rights and a property right as a legal concept.
