Sažetak
Uvođenje tehnoloških, ekonomskih ili organizacionih promena u proces rada može dovesti do ukidanja i smanjenja obima poslova koje obavljaju zaposleni na neodređeno vreme i uzrokovati prestanak potrebe za njihovim radom na tim poslovima, a u krajnjoj liniji, i prestanak njihovog radnog odnosa. Zbog toga, radno zakonodavstvo nastoji da, zaštitom zaposlenih na neodređeno vreme, za čijim radom prestaje potreba, svede na minimum obim i posledice utvrđivanja viška zaposlenih. U tom smislu, prestanak potrebe za radom zaposlenih na neodređeno vreme mora biti uzrokovan ozbiljnim i stvarnim razlogom; merila za utvrđivanje viška zaposlenih moraju biti objektivna i unapred utvrđena, a rešavanje socijalno-ekonomskog položaja onih koji predstavljaju višak utemeljeno na primeni mera koje vode očuvanju stabilnosti zaposlenja. Ukoliko ne postoji mogućnost njihovog alterantivnog zaposlenja, ukidanje ili smanjenje obima poslova koje su obavljali opravdava otkaz ugovora o radu od strane poslodavca. Ova i druga relevantna pitanja uređuje program rešavanja viška zaposlenih, u skladu sa zakonom.
Abstract
The introduction of technological, economic or structural changes in the labor market may lead to the abolishment of certain work positions or reduction in their scope, thus having dual consequences for permanent employees: the termination of the need for their work on these positions or termination of their employment. Consequently, labor legislation seeks to minimize the scope and consequences of the surplus employee determination by protecting permanent employees whose work is no longer required. The protection it provides to these workers involves, primarily, the existence of a real and serious reason for the termination of the need for their work, implementation of the objective pre-established criteria for identifying redundant workers and addressing their socioeconomic status by implementing measures that lead to preserving employment stability. If none of these measures can be applied, the employment of these workers will be terminated. This and other relevant issues are regulated by the redundancy program, in accordance with the law.
