Radni odnos na određeno vreme kao atipični radni odnos

Sažetak
Radni odnos na određeno vreme suštinski određuje ograničeno trajanje, zbog čega se kvalifikujekao izuzetak od pravila o zasnivanju radnog odnosa na neodređeno vreme i atipični radni odnos. Radni odnos u ovom modalitetu ima brojne potencijale. Radnim zakonodavstvom, otuda, treba uspostaviti širi pravni okvir za zaključivanje ugovora o radu na određeno vreme. Istovremeno, radnim zakonodavstvom treba zaštititi zaposlene koji rade na određeno vreme, što, pre svega, podrazumeva eliminaciju diskriminacije zbog ograničenog trajanja radnog odnosa, sprečavanje zloupotreba sukcesivnog zaključivanja ugovora o radu na određeno vreme i poboljšanje uslova rada zaposlenih koji rade na određeno vreme. Autorka je nastojala da osvetli neka aktuelna pitanja zasnivanja radnog odnosa na određeno vreme, ali i ciljeve i osobenosti zaštite zaposlenih koji rade na određeno vreme.
Abstract
Fixed-term employment essentially determines the limited time duration which is predetermined by objective reasons, such as the onset of the period, the execution of a particular job or the occurrence of certain events. Employed in this modality is, therefore, an exception to the rules on employment for an indefinite period and an atypical form of employment. The working relationship in this modality has a lots of opportunities. Therefore, labor legislation has a duty to facilitate the establishment and implementation of employment in this modality. At the same time, it should protect the employees at a time, which requires the elimination of the risk of discrimination, prevention of misuse of successive conclusion of the contract of employment for a definite period of time and the improvement of working conditions of employees for a limited time. The author has sought to highlight the objectives and characteristics of protection of employees working part-time, but the risks that threaten the well-being and dignity of this category of employees.
