Sažetak
Predmet rada su bitne odrednice,odnosno karakteristike i novine koje donosi novi srpski Zakon o ulaganjima iz 2015. godine. U drugom delu rada smo se bavili i njegovim dometima i efektivnošću pogledu privlačenja stranih ulaganja. Cilj rada je bio i da se i u ovom kontekstu izvrši kritička analiza konvencionalnih stajališta o značaju pravnih reformi u procesu privlačenja stranih ulaganja. U radu se zaključuje da je navedeni zakon o sadržinskom smislu, uglavnom zakon kontinuiteta, koji se zasniva se na principima liberalizacije, zaštite i podsticanja stranih investicija, uz posebne iskorake u nekim segmentima, posebno u pogledu njihove daljnje liberalizacije, Koncepcijski, najznačajnije novine se vezuju za sferu podsticaja investicija i stvaranje kompleksnog, pomalo i glomaznog sistema institucionalne podrške stranim ulaganjima. Zasnovana na ovakvom pristupu i rešenjima, novi predmetni zakonski okvir za strana ulaganja stvara povoljniji pravni ambijent za njihovu realizaciju. Međutim, iskustvo dosadašnjih zakonodavnih reformi u ovoj oblasti kod nas i uporednom pravu, ukazuje da su dometi tih poboljšanja dosta limitirani, te stoga teško mogu dovesti do izraženijih rezultata u privlačenju investicija, posebno s obzirom na ograničenja sadržana u samoj prirodi stranih investicija i realnom uticaju pravne regulative na lociranje stranih ulaganja.
