Interest and legal collective labor disputes

Abstract
Collective agreement, as a general act, which determines rights, obligations and responsibilities of employees arising out of labor relation and interrelationships of participants in conclusion of the collective agreement, is created when the meeting of minds is reached between negotiations participants. In the negotiations procedure for conclusion of collective agreement or its modifications and amendments a dispute between the participants may occur. Even when the collective agreement is concluded there can also be a dispute between contracting parties with respect to its application. The subject-matter of the collective labor dispute is either dispute with respect to conclusion of the collective agreement and/or its modifications and amendments or dispute with respect to application of the collective agreement. First type of collective disputes is named interest collective disputes, and second ones are legal collective disputes. Collective labor disputes may be resolved in front of arbitration, by conciliation, and if these means fail contracting parties of the collective agreements may protect its rights from the collective agreement before the competent court.
Sažetak
Kolektivni ugovor, kao opšti akt, kojim se uređuju prava, obaveze i odgovornosti zaposlenih iz radnog odnosa i međusobni odnosi učesnika u zaključivanju kolektivnog ugovora, nastaje saglasnošću volja učesnika u pregovorima. Isto tako potrebna je u njihova saglasnost kod izmena i dopuna kolektivnog ugovora. U postupku pregovaranja za zaključivanja kolektivnog ugovora ili njegovim izmenama i dopunama može da nastane spor između učesnika šokom pregovora. I kada se zaključi kolektivni ugovor takođe može da nastane spor između učesnika koji su ga zaključi, a povodom njegove primene. Predmet kolektivnog radnog spora je ili spor povodom zaključenja kolektivnog ugovora, odnosno njegovih izmena i dopuna ili spor povodom primene kolektivnog ugovora. Prvi kolektivni sporovi nazivaju se interesni kolektivni radni sporovi, a drugi pravni kolektivni radni sporovi. Kolektivni radni sporovi mogu da se rešavaju pred arbitražom, mirenjem, a ukoliko ovi načini ne uspeju, učesnici u kolektivnom ugovoru svoja prava iz kolektivnog ugovora mogu da zaštite i pred nadležnim sudom.
