Blokčejn kao pravni fenomen - uvodna razmatranja

Sažetak
Tema rada su polazne osnove za razmatranje blokčejna kao pravnog fenomena. Nastao kao kriptografski koncept, blokčejn danas dobija na značaju kao okvir za upravljanje i kontrolu postupcima u različitim društvenim oblastima. Rad je podeljen na dva dela. U prvom delu dat je pregled ključnih karakteristika pojma blokčejna i tehnologija distribuiranih delovodnih knjiga (e. Distributed Ledger Technology - DLT). Cilj ovog dela rada je postavljanje osnova za razmatranje opisanih fenomena kao pravnih pitanja, koje je učinjeno u drugom delu rada. Navedeni deo uključuje razmatranja pravnih definicija blokčejna i DLT tehnologije, uz pokušaj identifikacije osnovnih pravaca i formata pravnog njihovog pravnog uobličavanja blokčejn tehnologije. Značajan deo analize posvećen je tzv. "pametnim ugovorima": reč je o pitanju kroz koje se manifestuju i prelamaju dileme koje blokčejn aktivira u pravnom diskursu. Izlaganje je ilustrovano primerima iz selektovanih nacionalnih zakonodavstava koja regulišu blokčejn i DLT tehnologiju kao pravna pitanja.
