Ima li mesta potrošačkim ugovorima u novom Građanskom zakoniku Srbije?

Sažetak
Analizom sadržine Prednacrta Građanskog zakonika Srbije uočeno je da potrošački ugovori nisu sastavni deo ovog akta. S obzirom na činjenicu da oni postaju deo svakodnevnog života pojedinca, da su sve masovniji i sve prisutniji, postavlja se pitanje ima li im mesta u novom Građanskom zakoniku Srbije. Autor u radu polazi od trenutnog stanja regulative potrošačkih ugovora u srpskom pravu i suštinskog značaja pitanja unošenja potrošačkih ugovora u Građanski zakonik. U tom cilju ukazuje se na dva moguća sistema regulisanja potrošačkih ugovora: sistem jedinstvenog regulisanja sa ugovorima Građanskog prava i sistem odvojenog regulisanja pomenutih ugovora. Autor analizira prednosti i mane navedenih sistema, kao i rešenja usvojena u pojedinim zemljama EU Na kraju rada, prikazan je razvoj regulative potrošačkih ugovora u pravu EU.
Abstract
In analysis of contents of the Preliminary Draft of the Serbian Civil Code, it has been noticed that consumers' contracts are not an integral part of this act. Considering the fact that these contracts are becoming part of everyday life of each individual, that they are omnipresent, the issue if there is place for them in the new Serbian Civil Code has been raised. The author in this paper comes from the current state of consumers' contracts regulation in Serbian law, as well as from the substantial importance of the issue of implementing consumers' contracts in the Civil Code. With that aim, he suggests that there are two possible systems of consumers' contracts regulation: the system of unified regulation with the civil law contracts, and the system of separate regulation of these contracts. The author analyses advantages and weaknesses of the mentioned systems, as well as solutions adopted in some EU member states. At the end of the paper, development of consumers' contracts regulation in EU law has been shown.
