Sažetak
Karakteristika je arbitraže da stranke unapred predujmljuju iznose potrebne za rešavanje svog spora. Dešava se ipak da tuženi u arbitražnom postupku ne plati svoj deo predujma za troškove spora, i tako stavi tužioca u situaciju da sam finansira arbitražu. Nešto je ređa pojava da tužilac koji je pokrenuo spor ne plati svoj deo predujma. Predmet ispitivanja u ovom radu su posledice propuštanja tuženog da položi svoj deo predujma za troškove spora u investicionoj arbitraži koju organizuje ICSID - Međunarodni centar za rešavanje investicionih sporova u Vašingtonu. Prvo je izloženo, poređenja radi, kakve su posledice propuštanja tuženog prema drugim arbitražnim pravilima koja se takođe koriste u investicionoj arbitraži. Zatim je razmotrena mogućnost da arbitražni sud u ICSID-ovom postupku tužiocu koji je položio celokupni predujam delimičnom arbitražnom odlukom dosudi onaj deo predujma koji je trebalo da plati tuženi ili da odredi privremenu meru kojom se tuženi obavezuje da vrati tužiocu iznos koji je uplatio umesto njega. Na kraju se ispituje mogućnost da se u konačnoj arbitražnoj odluci, pri odmeravanju nadoknadivih troškova u arbitraži, uzme u obzir i činjenica da tuženi nije položio predujam ili da ga nije blagovremeno ili u celosti položio.
Abstract
This paper examines the consequences of the respondent's default in payment of the advance on costs in investment arbitration administered by the ICSID. First, it explores the consequences of the respondent's default pursuant to other arbitration rules also used in investment arbitration. Then it examines the possibilities for an arbitral tribunal in ICSID proceedings to award the claimant the substitute payment it made for the respondent in a decision or order prior to the final award. Finally, the paper discusses the possibility for the tribunal to take into account the respondent's default by apportioning costs in the final award.
