Međunarodno pravo kao činilac savremenog poslovanja
International law as a factor of modern business

Sažetak
Poslovanje danas nameće potrebu da bude usklađeno ne samo sa domaćim već i sa međunarodnopravnim normama i standardima. Od preduzetnika je nemoguće očekivati da budu upoznati sa svim normativnim promenama koje mogu uticati na poslovanje, budući da deo njih nema veze sa samom delatnošću ni administrativnom podrškom. Predmet ovog rada je niz činilaca međunarodnopravne prirode, koji proističu iz novog pristupa tehnološkom razvoju, finansijama, održivom razvoju, ekologiji i drugim oblastima, a koji determinišu usklađivanje odnosa preduzetnika prema korišćenju pravnih usluga. U radu se polazi od pretpostavka da okruženje novih tehnologija, intenzivne globalne međuzavisnosti i univerzalizacije vrednosti nameće pred poslovanje zahtev da se prema mogućim pravnim problemima postavlja unapred. Cilj rada proističe iz funkcije poslovanja, da pored dobiti, unapređuje društvenu stabilnost, zbog čega bi trebalo da ispunjava zahteve efikasnosti i održivosti, kako bi se obezbedila konkurentnost, što nameće potrebu da se preispita odgovarajućeg modela korišćenja pravnih timova u poslovanju. U tom kontekstu, u radu se analiziraju razvoj međunarodnopravnih izazova za poslovanje, pristup angažovanju pravnih stručnjaka i suočavanje sa savremenim normativnim okvirima u poslovanju. Rezultati analize daju osnova za tri zaključka: prvo, da korišćenje pravnih stručnjaka unapred predstavlja činilac efikasnosti i održivosti poslovanja, drugo, da savremeno poslovanje iziskuje oslanjanje na stručnjake koji raspolažu specijalizovanim pravnim veštinama i, treće, da pravni zastupnici postaju strateški partner preduzetništva koji utiču na definisanje budućnosti poslovanja.
Abstract
Business today imposes the need to be harmonized not only with domestic, but also with international legal norms and standards. It is impossible to expect entrepreneurs to be acquainted with all normative changes that may affect business, since some of them are not related with the activity itself or administrative support. The subject of this paper is a series of factors of international legal nature, which arise from a new technological development, finance, sustainable development, ecology and other areas, which determine the adjustment of entrepreneurs' attitudes towards the use of legal services. The paper starts from the premise that the environment of new technologies, intensive global interdependence and universalization of values imposes on business the requirement to set in advance according to possible legal problems. The aim of the paper stems from the business function, in addition to profit, to promote social stability, which is why it should meet the requirements of efficiency and sustainability, to ensure competitiveness, which imposes the need to reconsider the appropriate model of using legal teams in business. In this context, the paper analyzes the development of international legal challenges for business, the approach to hiring legal experts and dealing with modern normative frameworks in business. The results of the analysis provide a basis for three conclusions: first, that the use of legal experts in advance is a factor of business efficiency and sustainability, second, that modern business requires reliance on experts with specialized legal skills and, third, that legal representatives become strategic partners of entrepreneurship. defining the future of the business.
