Sažetak
Zakon o radu uvodi inspekciju rada kao organ nadzora nad njegovom primenom kao i primenom drugih propisa o radnim odnosima, opštih akata i ugovora o radu. Nadzor inspekcija rada vrši na dva načina: preventivno i represivno. Inspekcija rada vrši preventivni nadzor putem saradnje, savetovanja, davanjem instrukcija i pružanjem stručne pomoći poslovañu u primeni zakona. Represivni nadzor inspekcija rada vrši ukoliko utvrdi da je u primeni propisa došlo do povrede zakona, opšteg akta i ugovora o radu. Inspektor rada rešenjem nalaže poslodavcu da u određenom roku otkloni utvrđene povrede. Drugi vid represivnog nadzora je u vršenju zaštite prava zaposlenih. On se ogleda u pravu inspektora rada da podnese zahtev za pokretañe prekršajnog postupka ili u pravu inspektora rada da obustavi od izvršenja rešenje poslodavca o otkazu ugovora o radu ako je očigledno povređeno pravo zaposlenog, uz uslov da je zaposleni pokrenuo radni spor pred nadležnim sudom.
Abstract
Labour law introduces the inspection of the work as the organ which supervises its application, and it also supervises the application of the other working relations, general acts and contracts of the work. The inspection of the work carries out its supervision in two ways: preventive and repressive. The inspection of the work carries out its preventive supervision through cooperation, giving advice, giving instuctions and through offering professional help for the application of the law in business. Repressive supervision of the inspection of the work is used if it is established that in the application of the regulations the law was broken, or the general act or labour law were broken. The inspector of the work orders an employer to eliminate the established violations in the definite deadline. Another aspect of the repressive supervision is the protection of the employed. It is seen in the right of the inspector to submit a claim for the institution of the legal proceedings or in the right of the inspector of the work to stop the carrying out of employer's dismissal of the contract of the work if the right of the employed is violated, with the condition that the employed instituted legal proceedings in the competent court.
