Sažetak
Cilj ovog rada je prikaže nastojanja I preduzete aktivnosti međunarodnih organizacija I nacionalnih zakonodavstava, a naročito grčkog zakonodavstva, u pogledu zaštite kulturnog nasleđa određene države, koje se takođe određuje kao kulturna baština ili kulturno dobro. Od samog početka, tokom I nakon stvaranja moderne države, Grčka je veoma posvećena zaštiti kulturnih dobara, naročito u okviru međunarodne zaštite ovih prava, jer se često suočava sa krađom I pljačkom predmeta svoje kulturne baštine. Kako bi se povećala zaštita otuđenih kulturnih dobara, Grčka igra aktivnu ulogu na međunarodnoj sceni kroz borbu za restituciju ukradenih ili nezakonito izvezenih kulturnih dobara I njihov povraćaj u zemlje porijekla. Uprkos napretku koji je tokom poslednjih decenija ostvaren u pogledu zaštite kulturne baštine, još uvek ima dosta spornih pitanja koja se moraju razrešiti kako bi se postigao zadovoljavajući režim zaštite kulturnih dobara. Oni koji će se ubuduće baviti ovom materijom treba da posvete naročitu pažnju sledećim pitanjima: (1) omogućiti izjednačavanje statusa nezakonito izvezenih kulturnih dobara sa statusom ukradenih dobara, kako bi se povećao stepen njihove zaštite, u kombinaciji sa nastojanjem da se u određenoj meri ograniče kategorije kulturnih objekata koji zaslužuju veći stepen zaštite; (2) osigurati efikasnije dejstvo sertifikata o poreklu; (3) popraviti ili (još bolje) ukinuti režim tzv. bona fide kupovine kulturnih dobara; I (4) nastaviti borbu za restituciju ukradenih ili nezakonito izvezenih kulturnih dobara I njihov bezuslovni povraćaj u državu porijekla, bez ikakvih izgovora I ustupaka.
