Sažetak
Odlaganje izvršenja predstavlja specifičan institut izvršnog procesnog prava i jedan od oblika privremenog obustavljanja postupka izvršenja. Iako je postupak izvršenja koncipiran na načelima efikasnosti i hitnosti, kako bi se što pre konačno namirilo potraživanje izvršnog poverioca prinudnim putem, u postupku izvršenja može doći do odlaganja izvršenja. Ovaj institut izvršnog procesnog prava nije bio regulisan odredbama Zakona o izvršenju i obezbeđenju iz 2011. godine, da bi ga zakonodavac ponovo normativno uredio odredbama važećeg Zakona o izvršenju i obezbeđenju koji je donet 2015. godine. U radu su analizirane odredbe koje se odnose na odlaganje izvršenja na predlog izvršnog poverioca, izvršnog dužnika i trećeg lica, i detaljno su obrađeni uslovi koji moraju biti ispunjeni kako bi do odlaganja izvršenja došlo na predlog jedne od stranaka ili trećeg lica. Takođe, pažnja je posvećena i sporazumu o odlaganju izvršenja. Ovaj sporazum, koji je po prvi put regulisan zakonom, zaključuju stranke u postupku izvršenja ili stranke i treće lice i on predstavlja osnov za donošenje rešenja o odlaganju izvršenja.
Abstract
Enforcement postponement represents a specific institute of executive procedural law and one of the ways of temporary suspension of the procedure of enforcement. Although the procedure of enforcement is based on the principles of efficiency and urgency, so that the executive creditor's receivables are settled forcedly as soon as possible, enforcement postponement can occur in the procedure of enforcement. This institute of executive procedural law had not been regulated by the Law on Enforcement and Security in 2011. However, the legislator regulated it normatively in the applicable Law on Enforcement and Security in 2015. The author analyzes the regulations related to the enforcement postponement on the request of the executive creditor, executive debtor and third party. Also, conditions that have to be fulfilled in order for the enforcement to be postponed on the request of one of the parties or third party are dealt with in detail. Additional attention is devoted to the agreement on enforcement postponement. This agreement, which is regulated by law for the first time, is concluded by the parties in the procedure of enforcement or the parties and third party and it represents the grounds for bringing a decision on enforcement postponement.
