Savremene koncepcije pojma "poslodavac"

Sažetak
U savremenom radnom pravu se, redovno, daje definicija pojma "poslodavac". Dok razlog za definisanje zaposlenog leži u potrebi određivanja personalnog područja primene radnog zakonodavstva, smisao zakonskog definisanja pojma "poslodavac" je da se utvrdi ko preuzima odgovornost za ispunjenje obaveza prema zaposlenima i drugim radnoangažovanim licima ili njihovim sindikatima i drugim institucijama predstavničkog karaktera. Međutim, uprkos značaju preciznog definisanja, uporedno radno zakonodavstvo gotovo da i ne poznaje primere definicija pojma poslodavca u kojima su se zakonodavci izdigli iznad definicije idem per idem. Osim toga, postojeće definicije nisu prilagođene triangularnim (i multilateralnim) odnosima koji nastaju povodom rada. Stoga, da bi se pravni okvir uskladio sa promenama koje se dešavaju u ekonomskoj stvarnosti, sve veći broj radnopravnih sistema otpočinje proces uvođenja novih zakonskih koncepcija množine poslodavaca. U tom smislu, autor u radu, najpre, razmatra potrebu rekonceptualizacije pojma "poslodavac", a potom analizira (postojeće) unitarne i (nove) pluralne koncepcije ovog pojma. Na kraju, kroz primer digitalnih platformi autor ukazuje na neadekvatnost postojećih zakonskih definicija pojma "poslodavac" i potrebu uvođenja novih, prilagođenih realnostima na tržištu rada.
