Employment dispute: Actual problems in jurisprudence and employers practice

Abstract
Employment dispute - urgent or slow? Urgent - according to the provisions of Civil Procedure Act. Slow - according to what is really happening in Serbian judiciary. Beside the problem of real employment dispute duration, the author in this paper points to several more issues - problems that appear in our jurisprudence and employers labor legal practice. These problems are related to the interpretation and application of Labor Law provisions, and in particular to the issue what should be included by complaint for annulment of employers cancelation decision, according to amended regulation of the mentioned law from July 2014.
Sažetak
Radni spor - hitan ili spor? Hitan - prema odredbi Zakona o parničnom postupku. Spor - prema onom što se realno dešava u srpskom pravosuđu. Osim problema realnog trajanja radnog spora, autor u ovom radu ukazuje na još nekoliko pitanja - problema koja se pojavljuju u našoj sudskoj praksi i radnopravnoj praksi poslodavaca. Ti problemi su vezani za tumačenje i primenu odredaba Zakona o radu, a naročito se odnose na pitanje šta sve treba obuhvatiti tužbom za poništaj otkaznog rešenja poslodavca, prema izmenjenoj i dopunjenoj regulativi navedenog zakona iz jula 2014. godine.
