Sažetak
Budući da je procesom fragmentacije međunarodnog javnog prava omogućeno formiranje brojnih pravnih režima, postavlja se pitanje kvalifikacije pravnog poretka Evropske unije (EU). Naime, on se dugo nije sagledavao kao samostalan režim, čemu je indirektno doprinela i klasifikacija iz Izveštaja Komisije za međunarodno pravo "Fragmentacija međunarodnog prava: Teškoće koje proizlaze iz diverzifikacije i širenja međunarodnog prava". Ovim Izveštajem je pravo EU (tačnije evropske integracije) svrstano u odeljak o regionalizaciji, čime je on relativizovan time što je sveden na saradnju država određenih jedino po geografskom kriterijumu. Iako nesporan, geografski kriterijum je sekundaran u odnosu na niz drugih argumenata koji uzmaju u obzir njegovu kvalitativnu dimenziju. Činjenica je da se sui generis pravni poredak EU nalazi u konstantnoj evoluciji, te postepeno ostvaruje sve veći stepen autonomije od opšteg međunarodnog javnog prava. Stoga se postavlja ključno pitanje da li je pravni poredak EU dostigao takav stepen razvoja i kvaliteta da se može smatrati samostalnim pravnim režimom. U traženju odgovora na postavljeno istraživačko pitanje, u radu se analiziraju argumenti pro et contra.
