Koncept "ugroženi potrošač" u pravu EU i srpskom pravu
Concept 'vulnerable consumer' in EU and Serbian law
Sažetak
Predmet rada je razmatranje mogućnosti uvođenja posebnog pravnog režima zaštite ugroženih potrošača. Specijalna pravila zaštite ove heterogene grupe potrošača mogu se odrediti i primeniti samo ako je jasno određen opšti pojam "ugroženi potrošač". Uporednopravno istraživanje je pokazalo da taj zahtev još uvek nije ispunjen na način da bude široko prihvatljiv, kao i da se sa više uspeha određuje posebni pojam "ugroženi potrošač", koji je vezan za pojedine delatnosti, odnosno sektore. U ovom radu se istražuju i analiziraju razlozi koji objašnjavaju navedenu pojavu. Na primeru "energetski ugroženog kupca" se razmatra specijalna pravna zaštita sektorski ugroženih potrošača u pravu EU i Republici Srbiji. U zaključku se, na osnovu istra ženih primera dobre prakse i komparativnih iskustava, ukazuje na to da ima dosta prostora za poboljšanje položaja ugroženih potrošača u sferi delovanja trgovaca. Trgovci bi trebalo da se osposobe da prepoznaju ugroženog potrošača i da odgovorno i savesno udovolje njegovim posebnim potrebama.
Abstract
The subject of this paper refers to a special legal regime for vulnerable consumers protection. Special rules for their protection may be determined and applied only if the general term "vulnerable consumer" is clearly defined. Comparative legal research has shown that this requirement has not yet been met in a way that it is widely recognized as acceptable. However, the special term "vulnerable consumer", which is related to certain economic sectors, has been defined with more success. This paper explores the reasons which explain this and analyse the special legal protection of consumers in EU and Serbia on the example of an energy vulnerable customer. Based on examples of good practice, it is indicated that there is a lot of space for improving the position of vulnerable consumers if traders recognize the special needs of them and if they act responsibly and in accordance with the principle of good faith.
