One of the unavoidable issues of approaching reform of penal legislature refers to the expert's report in the criminal procedure. There are a lot of reasons for that, and very important, such as the issue of experts selection and disqualification, the possibility to enhance the efficiency of expert's report by application of some elements of court expert's report contradictory concept, time-restriction of the duration of the defendant observation in the health institution because of the expert's report on mental conditions, are discussed in this paper. After the elaboration of existing procedure of experts selection according to the provisions of the Law on criminal procedure and Law on the conditions for expert's report duties discharge, the author concludes that there is not an effective control system of expert's professional competence and that existing lists of standing court experts do not provide experts selection with appropriate professional profile and to that effect suggests concrete modifications of these laws. The author also suggests that existing problems should be solved by either analogue application of judge disqualification provisions to the expert disqualification, or by separate norm-setting of the expert disqualification conditions. Time limitation for the mental observation in health institution is also suggested as well as the possibility to solve expert's report issues obtained beyond Law on criminal procedure, article 242, by introduction of some elements of the contradictory principle of the court expert's reports.
