Terrorism as unfinished war: Definition of the problems

Abstract
In this paper, the author presents that the terrorism representative constant of human society. In this sense, the author analyses previous attempts to notionally define terrorism, suggests different approaches in determination of terrorism, justification of terrorism, types and characteristics of terrorism, where the reasons why terrorism has not yet been integrally defined could be found. As a consequence to this fact, it arises that terrorism is not included in the Statute of the International Criminal Court, as well as different reactions to terrorism through global war against terrorism, with special repercussions. The author essays, by determining the characteristics of terrorism through history, to indicate the complexity of this phenomenon, which imposes the need of alternate defining, as well as finding other ways of reaction and campaign against terrorism. In the end, the author points out the necessity of taking the new approach in defining terrorism, the necessity of accepting the unique approach to terrorism, which the adequate measures against terrorism will follow.
Sažetak
U radu autor je imao cilj da objasni terorizam kao reprezentativnu konstantu ljudskog društva. Zbog toga je izvršena analiza dosadašnjih pokušaja pojmovnog definisanja terorizma, ukazuje na različite pristupe u određivanju terorizma, opravdanju terorizma, vrste i karakteristike terorizma u kome se mogu naći razlozi nepostojanja jedinstvene definicije terorizma. Kao posledica navedenog ističe se da terorizam nije obuhvaćen statutom Stalnog međunarodnog krivičnog suda, kao i različite reakcije na terorizam u vidu globalnog rata protiv terorizma, sa posebnim reperkusijama. Utvrđivanjem karakteristika terorizma kroz istoriju autor ukazuje na kompleksnost pojave koje nameće potrebu kako drugačijeg definisanja, tako i iznalaženje drugačijih oblika reakcije i borbe protiv terorizma. Na kraju, naglašena je neophodnost novog pristupa definisanju terorizma, potrebu opšteg usvajanja jedinstvenog pristupa terorizmu kako sa kriminološkog, tako i sa pravnog aspekta iz čega bi usledile i adekvatne mere protiv terorizma.
