Sažetak
Uvod/Cilj U praksi se već više od deset godina vode sudski sporovi između zdravstvenih ustanova i zdravstvenih radnika kojima je utvrđeno skraćeno radno vreme povodom isplate dodataka na platu za prekovremeni rad (dežurstva, rad po pozivu, pripravnost). Cilj rada je analiza problema i predlog rešenja kako bi se obustavili sporovi i otklonila neizvesnost. Metode U radu je korišćen metod studije slučaja, uporedni metod i normativni metod. Analizirana je sudska praksa povodom većeg broja parničnih postupaka kao i mišljenja Državne revizorske institucije Republike Srbije i Ministarstva državne uprave i lokalne samouprave po konkretnom slučaju. Rezultati Zdravstveni radnici i zdravstvene ustanove imaju različite pravne stavove o pravu na dodatke na platu po osnovu prekovremenog rada zdravstvenih radnika koji rade sa skraćenim radnim vremenom. Iako je sud zauzeo stav na strani zdravstvenih radnika, sporovi ne prestaju jer zdravstvene ustanove ne menjaju svoj način obračuna. Zaključak Rešenje problema je u izmeni pravnih propisa kojima treba detaljno i nedvosmisleno urediti način isplate dodataka na platu za zdravstvene radnike kako bi se izbegle sve nedoumice i sporne situacije.
